![]() Muhlenberg argues that Allentown’s zoning amendment is unconstitutional because it singles out students, is arbitrary and constitutes spot zoning. Davison, has promised repeatedly to fight Allentown’s Student Residence Overlay District all the way to the U.S. 25, and the college’s legal counsel, Maxwell E. 15, up to four students could reside together anywhere they pleased. But the big change under the zoning amendment is that only two students may now reside in the district’s estimated 830 single-family dwellings. Noncompliance by tenants can lead to evictions, and landlords who shirk the requirements can lose their operating licenses.Īllentown’s law allows landlords in a new student residence district surrounding the campus to rent to four students only if the properties are detached dwellings already divided into at least two units. The law has strong enforcement provisions. Most importantly, it allows no more than three unrelated people to live together.
